TERMS AND CONDITIONS
These conditions are agreed between Imom Museum, Lda., Rua dos Aranhas, nº 98, 3rd floor, 9000-042, Funchal, 518758672, hereinafter referred to as IMOM, and any person wishing to purchase tickets online for the museum, hereinafter referred to as the user.
PURPOSE
The present conditions aim to define the general terms of sale on www.IMOM.pt established between IMOM and the user, regulating all the necessary steps to complete the online purchase of tickets for exhibitions, cards, and products, following the instructions provided therein. Tickets are sold using the Tickera extension.
TICKETS
To successfully complete the online purchase of tickets, the user must follow the steps below:
❶ Selection of ticket type. ❷ Select date and time. ❸ Provide visitor details for each ticket. ❹ Enter payment information. ❺ Apply discount code. ❻ Confirm purchase summary. ❼ Finalize: Make the payment.
The user will receive the ticket via email or SMS, which can be presented on their mobile phone at the museum entrance. Tickets can also be added to Apple Wallet and shown at the entrance. Alternatively, the ticket may be printed in PDF format. The invoice will be sent to the user’s email.
PAYMENT
At IMOM, purchases can be made using VISA or MASTERCARD Credit/Debit cards, through reference payment. Credit card payment validation is ensured by Stripe. In the event of fraudulent use of cards, the seller reserves the right to cancel transactions associated with that payment method. Payment may also be made through the Klarna platform.
PRICES
Prices are to be understood in euros.
PURCHASE COSTS
Purchases made on the IMOM website do not entail the payment of operating costs. All prices presented already include VAT (applicable on the day of purchase).
LIABILITY
All content and prices described and presented on the website are the responsibility of IMOM and may be modified at any time, without prior notice. IMOM excludes all warranties and any liability for inconveniences or damages inherent to the use of the Internet or any case of force majeure as classified by court case law, to the extent permitted by applicable law.
If, despite all our precautions, errors occur on this website, IMOM cannot be held responsible. IMOM reserves the right to cancel a purchased ticket and refund the amount paid if:
The amount paid for a ticket is incorrect, whether due to an error in the price published on this website or communicated otherwise;
A ticket is acquired that should not have been made available for sale.
This measure will apply whether the error is due to human failure or a technical failure of the Tickera platform.
The user purchasing tickets is responsible for their own data. Two checkboxes are presented for the user to select:
☐ I have read and accept the Terms and Conditions for the purchase and sale of tickets for IMOM, consenting to the collection and processing of the personal data entered in the form for the processing and delivery of tickets.
☐ I have read and do not accept the Terms and Conditions for the purchase and sale of tickets for IMOM, not consenting to the collection and processing of the personal data entered in the form for the processing and delivery of tickets.
By selecting the first option, the customer confirms the conclusion of the purchase contract and acknowledges that their personal data will be processed by IMOM to the extent necessary for the transaction, in accordance with the applicable legislation. In the event that the second option is selected, the user is redirected to a notice indicating that they must use alternative means to purchase tickets, namely by going in person to the Museum’s ticket office.
WARRANTY
All sales are final, and exchanges or refunds are not accepted, except in cases specifically provided for in these Terms and Conditions.
Rescheduling the ticket date is permitted.
Only in the event of a duplicated transaction error is cancellation and full reimbursement of the amount paid guaranteed.

If necessary, any requests for information, questions, or complaints must be addressed to the email tickets@imom.pt or to R. dos Aranhas, São Martinho, 9000-042, Funchal.
PRIVACY AND SECURITY POLICY
IMOM adopts all technical and organizational measures to ensure the privacy of the information entrusted to it. Reading the website’s Privacy Policy is recommended. Data will not be retained, stored, or used for purposes other than processing ticket purchases.
APPLICABLE LAW AND JURISDICTION
In situations not provided for in this contract, the regime of purchase and sale, electronic and distance transactions shall apply with the necessary adaptations. This platform was created in accordance with Portuguese law. In case of dispute, the consumer may resort to the Consumer Conflict Arbitration Center of the Autonomous Region of Madeira (CACC RAM), an alternative dispute resolution entity (ADR), under Articles 5 and 16 of Law No. 144/2015 of September 8, which transposed Directive 2013/11/EU of the European Parliament and of the Council on ADR, establishing the legal framework for out-of-court consumer dispute resolution mechanisms.
